Erotic Reads hosts recordings submitted by members. We respect the rights of authors, translators, performers, and recording owners, and we respond to specific copyright claims under this process.

Notification of claimed infringement

If you own copyright, or are authorized to act for an owner, send a written notice to the designated agent containing all of the following:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if one notice covers multiple works on Erotic Reads.
  3. Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it, preferably the exact Erotic Reads URL and reading title.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the exclusive right allegedly infringed.

After receiving a substantially compliant notice, we will act expeditiously to remove or disable access to the identified material and take reasonable steps to notify the member who submitted it.

Counter-notification

A member who believes material was removed through mistake or misidentification may send the designated agent a written counter-notification containing:

  1. The member's physical or electronic signature.
  2. Identification of the removed material and the location at which it appeared before removal or disabling.
  3. A statement under penalty of perjury that the member has a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. The member's name, address, and telephone number, plus consent to the jurisdiction of the appropriate U.S. Federal District Court and acceptance of service of process from the original claimant or the claimant's agent, as required by 17 U.S.C. § 512(g)(3).

We will forward a compliant counter-notification to the original claimant. We will restore the material between 10 and 14 business days after receiving it unless the claimant informs us that a court action has been filed seeking to restrain the member's allegedly infringing activity.

Repeat infringement

Erotic Reads maintains a repeat-infringer policy. In appropriate circumstances, we may restrict or terminate the accounts of members who repeatedly infringe copyright. We may also remove material when infringement is apparent, independently of a formal notice.

Accuracy and privacy

Knowingly making a material misrepresentation in a notice or counter-notification may result in liability under 17 U.S.C. § 512(f). Consider whether a licence, public-domain status, fair use, fair dealing, or another legal exception applies before submitting a claim.

Notices and counter-notifications are legal communications. We may share them, including the sender's contact details, with the affected member, claimant, professional advisers, service providers, or authorities as necessary to process the claim and comply with law.

Copyright concerns arising outside the United States may be sent to the same designated agent and will be considered under applicable law.
